Protecting Amenity

Concordia Pacific can help you if the amenity of your home is being adversely affected by activities in the surrounding neighbourhood.

Concordia Pacific can assist you, as well as others in your community, who may be suffering from the impacts of activities that are prohibited under the Environmental Planning and Assessment Act or the Local Government Act. We can quickly commence proceedings to restrain conduct that is carried out either without development consent, or in contravention of the terms of a development consent. We will aggressively pursue these proceedings on your behalf until the problem is satisfactorily resolved.

Because of the increasing density of the population of New South Wales, especially in the inner-city neighbourhoods of Sydney, we are all becoming more and more vulnerable to the negative impacts of urban life. The quiet enjoyment of our homes and apartments can be disturbed by late-night noise from nightclubs and hotels; by people congregating on footpaths outside unauthorised backpackers' hostels or brothels; by brightly lit advertising signs; and by noise from the operation of air conditioners, exhaust fans and other plant and equipment on the roofs of apartment and commercial buildings. We may also suffer from late-night or early morning noise associated with trucks making deliveries to commercial establishments, or from odours that are being emitted from restaurants and other businesses.

The amenity of our residences may also be affected by unauthorised building works that intrude upon our privacy, or that obstruct views that we cherish. In fact, our very safety may be affected if buildings are not properly maintained, and risks develop that dilapidated building walls or roof elements could fall onto the public footpaths that we walk on.

Although local councils theoretically have power under the Environmental Planning and Assessment Act and the Local Government Act to protect the public from adverse impact on the quality of urban life, because of limited budgets and staff resources they often respond slowly.

Fortunately, any person - not just a council - has a right to bring proceedings in the Land and Environment Court to enforce the Environmental Planning and Assessment Act and the Local Government Act.

Therefore, if you find that your local council is not investigating your complaints, or is not taking timely action to make sure that they are resolved, Concordia Pacific can act forcefully to protect your rights.
